1. The petitioner, who is serving as Constable(GD) in the CRPF has approached this Court assailing the order dated 29.01.2024, vide which he was transferred from 55 Bn, Bawana, New Delhi to 191 Bn. Gadchiroli, Maharashtra.
2. We may note that during the pendency of the present petition, the respondents have recalled the impugned order transferring the petitioner to 191 Bn. Gadchiroli, Maharashtra and have now posted him to 133 Bn. Ranchi, vide their order dated 26.02.2024.
3. After arguing the matter at length, learned counsel for the petitioner, on instructions, from the petitioner, who is present in Court submits that the petitioner would be satisfied, in case, he is granted time till 30.09.2024 to join his new place of posting at 133 Bn. Ranchi. The petitioner, who is present in Court, undertakes that he will report at the Headquarters of 133 Bn. Ranchi on or before 30.09.2024. 4. At this stage, learned counsel for the respondents submits that an appropriate movement order will be issued to the petitioner to enable him to report at Headquarters 133 Bn. Ranchi on or before 30.09.2024.
5. In the light of the aforesaid stand taken by the parties, the writ petition along with the pending application is disposed of by granting time to the petitioner to report at Headquarters 133 Bn. Ranchi on or before 30.09.2024.
6. It is made clear that, in case, the petitioner does not report at Headquarters of 133 Bn. by 30.09.2024, it will be open for the respondents to not only take appropriate disciplinary action but also initiate contempt proceedings against him.
