Learned counsel appearing for the petitioner, after arguing for a while, seeks leave to withdraw the instant petition with liberty to file an appropriate application before the Appellate Tribunal of Municipal Corporation of Delhi (hereinafter referred to as the 'ATMCD').

Learned counsel for the petitioner, however, submits that the period of for filing of the appeal may kindly be extended for the reasons that the impugned notice was never served upon the petitioner till recently. All those aspects can be pointed out to the ATMCD and if that is done, let ATMCD to consider the explanation of delay in approaching to the said authority, appropriately.
