CRL.REV.P. 24/2020 & CRL.M.As. 574-576/2020 The present revision petition has been filed by petitioner under Section 397 read with Section 401 Cr.P.C. challenging order dated 23.11.2019 passed in case bearing No. CC/250/2017 passed by learned Judge, Family Court, East District, Karkardooma Court, Delhi. It is agreed by petitioner that he shall pay an amount of Rs.5,000/- per month w.e.f. March, 2020. It has also been agreed by petitioner that if any amount is due @ Rs.4,000/- per month in terms of interim award passed by Family Court, the same shall be cleared by him within four weeks from today.

Petitioner is directed to handover original ESIC card to respondent

within two weeks from today. On receipt of card, respondent shall apply for reimbursement of the amount spent on her treatment. It is made clear that if respondent does not get reimbursement due to any reason, petitioner shall pay the claimed amount in favour of respondent within four weeks from the date of rejection of the same. It is further made clear that amount of Rs.5,000/- per month shall be paid to respondent on or before 10th day of every calendar month failing which petitioner shall pay an additional amount of Rs.2,000/- to respondent towards costs.

Since matter of maintenance has finally been settled between parties, petitioner has undertaken before this Court to withdraw petition filed by him under Section 340 Cr.P.C.

For aforesaid purpose, steps shall be taken within one week from today.

In view of above, I hereby set aside order dated 23.11.2019. Since matter has been settled, therefore, case bearing No.

CC/250/2017 pending before the Court stands closed. The petition is, accordingly, allowed and disposed of. Pending applications stand disposed of.
