% 17.05.2019 Petitioner seeks regular bail in FIR No.474/2018 under Section 363 of IPC registered at police station Ghazipur, Delhi in which charge-sheet for the offences under Sections 363/376/34 of IPC and under Sections 4/17 of POCSO Act (The Protection of Children from Sexual Offences Act 2012) has been filed.
Learned counsel for petitioner submits that prosecutrix was aged seventeen and half years and her statement recorded under Section 164 of Cr.P.C. supports the case of petitioner. It is submitted that petitioner is in custody since 17th October, 2018.
However, learned Additional Public Prosecutor for respondentState opposes this application. BAIL APPLN. 215/2019
Upon hearing and on perusal of the charge-sheet filed, I find it to be a fit case for grant of bail. Subject to petitioner furnishing bail bond in the sum of ₹20,000/- with one local surety in the like amount to the satisfaction of trial court, he be released on bail forthwith, if not wanted in any other case.
With aforesaid directions, this application is disposed of. Dasti.
