% 12.03.2025 1.
This is a petition filed under Section 482 of Cr.PC seeking quashing of F.I.R No. 0047/2014 dated 10.02.2014 under Sections 406/420/34 of IPC registered at Police Station Lahori Gate, New Delhi. 2.
As per the F.I.R, the petitioner assured fine quality paddy worth Rs. 5.45 crores to the complainant.
3.
On assurances of the petitioner, the complainant remitted amounts to the petitioner for supply of paddy.
4.
However, neither paddy was supplied, nor the amounts advanced were returned.
5.
Hence the F.I.R was registered.
6.
During the pendency of the proceedings, the parties have arrived at a settlement dated 21.10.2019 for a sum of Rs. 40 lakhs, out of which Rs. 20 lakhs has already been paid to the complainant and the disputes arising out of the said F.I.R also have been settled. 7.
I am of the view that the settlement is legal, valid and binding and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/07/2025 at 10:13:28
executed by the parties out of their own free will, volition and without any threat, force, undue influence or coercion. 8.
Mr. Ravi Grover, learned counsel appears on behalf of the complainant and confirms the same.
9.
Since the parties have arrived at a settlement and no disputes are pending, I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further. It is a fit case for quashing. In this view of the matter, there is no reason to continue the proceedings.
10.
In this view of the matter, F.I.R No. 0047/2014 dated 10.02.2014 under Sections 406/420/34 IPC registered at Police Station Lahori Gate. New Delhi and consequential proceedings emanating therefrom are hereby quashed.
11.
An amount of Rs. 20 lakhs is lying deposited with the learned ACMM, Tis Hazari Court, Delhi in F.I.R No. 0047/2014. 12.
The amount of Rs. 20 lakhs along with up to date accrued interest shall be released in favour of respondent No. 2 through its duly authorized agent/ counsel.
13.
The petition is disposed of accordingly.
