O R D E R

% 04.02.2019 Respondent nos. 2 to 4, namely, Mr. Jagdish, Mr. Deepak and Ms. Savitri are present in Court and have been identified by SI Amit Nara of police station Mangol Puri.

It is submitted that petitioners and respondent nos. 2 to 4 are neighbours. A quarrel took place between them on some trivial issue, which led to registration of FIR no. 258/2017 under Sections 323/341/34 IPC at police station Mangol Puri on the complaint of respondent no. 2. During the investigation, offence under Section 323 IPC was converted to Section 308 IPC. It is submitted that petitioners and respondent nos. 2 to 4 have settled

their disputes amicably, vide a Memorandum of Understanding/Mutual Deed dated 17th November, 2018.

Respondent nos. 2 to 4 admit having settled the matter with petitioners of their own free will, voluntarily and without any undue force, pressure or coercion and they have no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioners. Affidavits of respondent nos. 2 to 4 to this effect are on record.

Keeping in mind the settlement arrived at between the petitioners and respondent nos. 2 to 4, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.
