By way of this petition, under Article 226 of Constitution, the petitioner has challenged the vacation notice dated 30.01.2024 issued by the respondent - Municipal Corporation of Delhi ["MCD"], by which she was directed to vacate the premises [B-2/3, Third Floor and Terrace, Safdarjung Enclave, New Delhi-110029].

Learned counsel for the MCD states that the vacation notice was issued pursuant to a demolition order dated 05.09.2023. The petitioner has challenged the demolition order before the Appellate Tribunal for Municipal Corporation of Delhi ["ATMCD"]. states that the demolition action has also been taken before the matter was listed before the ATMCD 3.

All the necessary facts may be brought before the ATMCD, which will take an appropriate decision in the matter. As far as the present writ petition is concerned, the vacation notice is consequential upon the demolition order and it is only necessary to say that the MCD will abide by the result of the appeal.

The writ petition, alongwith the pending applications, is disposed of.
