+ BAIL APPLN. 220/2019 & CRL.M.(BAIL) 178/2019 JOGINDER @ JOGI ..... Petitioner Through Ms Manisha Parmar and Ms Siddhi Mittal, Advocates.

versus STATE ..... Respondent Through ASI Pardeep Kumar, P.S. F.P. Beri.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 05.11.2019 1.

The petitioner has filed the present petition, inter alia, praying for anticipatory bail in connection with FIR No. e-039373/2018 under Section 379 of the IPC registered with P.S. Fatehpur Beri, Delhi. 2.

It is the petitioner's case that the petitioner had purchased the vehicle in question (Thar Jeep bearing no. DL-1Temp-AX-A555) from one Aman Rana for a total consideration of ₹10,00,000/-. The petitioner further states that ₹7 lakhs had been paid to Mr Aman Rana out of which ₹3,50,000/- were paid through banking channels.

3.

On 20.08.2019, this Court had directed that the investigating agencies to carry out investigation qua Aman Rana. A status report has since been filed which indicates that NBWs have been issued against Aman Rana and efforts are being made to investigate further. 4.

It is alleged that the petitioner had committed the offence jointly with one Deepak, who has already been released on bail.

5.

Considering the above and considering that the petitioner has joined the investigation and is co-operating with the investigation agency, this Court considers it apposite to allow the present petition. 6.

The petitioner is released on anticipatory bail on his furnishing a personal bond in the sum of ₹50,000/- with one surety of the equivalent amount to the satisfaction of the concerned Investigating Officer. This is also subject to the condition that the petitioner shall continue to cooperate with the IO. The petitioner shall also provide his mobile number to the IO and ensure that he is reachable at all times. 7.

The application is disposed of.
