% 05.09.2017 The petition is based upon a power of attorney executed on 8th January, 2016, ostensibly filed by one Suresh Aggarwal, the land owner, however, it is executed by one Sh. Arun Tiwari. The affidavit/power of attorney of Sh. Arun Tiwari is not on record. In these circumstances, the Court is of the opinion that the petition is not maintainable. At this stage, learned counsel for petitioner seeks liberty to withdraw the writ petition and to file proper petition on behalf of land owner who is in fact affected by the acquisition. Liberty granted. The petition alongwith pending application is dismissed as withdrawn.
