The Petitioner assails order dated 25th November, 2024, passed by the Judicial Magistrate First Class (NI Act-01), Dwarka Courts, Delhi, whereby the application of the Petitioner, seeking forensic examination of the disputed signature of the Complainant (Respondent herein) on the receipt marked as Ex. CW-1/DX1, was rejected.

Initially, the Petitioner's primary request to the Court was to get the disputed signature of the Complainant on the aforenoted receipt examined by the FSL. However, as noted in the previous order, Mr. Satish Tamta, Senior Counsel for the Petitioner, states on instructions that the Petitioner is not pressing for the document to be examined by FSL, but is now only seeking to examine a handwriting expert as an independent witness, regarding the disputed signatures on the afore-noted document. 3.

petition and submits that the Petitioner is unnecessarily delaying the matter. 4.

The Court has considered the aforenoted submissions. The request of the Petitioner for examining a handwriting expert on the exhibit marked as Ex. CW-1/DX1, ought to be accepted as it is germane to the case. 5.

Therefore, the impugned order dated 25th November, 2024 is modified and the Petitioner is permitted to examine a handwriting expert on Ex. CW1/DX1. Let the list of witness, with the name of the handwriting expert sought to be examined as a witness, be filed within one week from today before the Trial Court. Furthermore, the testimony of the said witness be recorded on 27th March, 2025 and the matter then be heard by Trial Court on the date fixed, i.e., 01st April, 2025, or on any other date convenient to the Trial Court.
