O R D E R

The present bail application has been filed under Section 438 Cr.P.C. on behalf of the petitioner seeking anticipatory bail in case FIR No.228/2019, registered under Sections 323/354/506/509 IPC at Police Station Lodi Colony, New Delhi.

Learned counsel for the petitioner submits that the petitioner is 67 years of age and running an NGO. He is involved in number of Public Interest Litigation on account of which, the complainant and her family developed a grudge against him. It is submitted that the petitioner had filed complaint dated 22.11.2019, 25.11.2019 and 16.12.2019 against the complainant and the present complaint is filed as a counterblast. Lastly, it was submitted that the petitioner has already joined the investigation. 3.

Learned APP for the State, on the other hand, opposes the grant of anticipatory bail to the petitioner on the ground that he has been found to be involved in other similar cases, details of which are mentioned in the status report.

In rebuttal, learned counsel for the petitioner submits that in other cases, either the petitioner has been acquitted or he has been enlarged on bail.

In view of the totality of the facts and circumstances, it is directed that in the event of arrest, the petitioner be admitted to bail, on his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount, to the satisfaction of the concerned IO/SHO, subject to the following conditions:- (i) The petitioner shall join investigation as and when he is asked to do so.

(ii) The petitioner shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (iii) The petitioner shall provide the I.O./SHO Police Station Lodi Colony with his mobile number and in the event of change of his residential address, shall inform the same to the I.O./SHO as well as to the concerned Court. (iv) The petitioner shall not leave the jurisdiction of the National Capital Territory of Delhi without prior permission of the concerned Court.

The bail application is disposed of in the above terms. 7.

Copy of the order be given dasti to the learned counsel for the petitioner.
