W.P.(C) 864/2019 & C.M. Nos. 3907,3908/2019 The petitioners have preferred this writ petition without first approaching the Tribunal.

The submission of Mr. Rao is that since the Tribunal has already rendered its decision, which is against the interest of the petitioners, there was no purpose in first approaching the Tribunal. He points out that W.P.

(C) No. 109/2019, Himanshu Kumar Verma and Anr. v. Union of India and Ors., is already pending consideration before this Court wherein the decision of the Tribunal is under examination. The petitioners have also moved an application i.e. C.M. No. 3908/2019 to seek leave for listing of the petition before this Court without first approaching the Tribunal. Issue notice. Counsel for the respondents accept notice. Counter affidavit(s), if any, be filed within 4 weeks. Rejoinder be filed before the next date of hearing.
