The present petition has been filed by the Petitioner- Rocky under Article 226 of the Constitution of India, inter alia, seeking directions to the Respondents to conduct the survey of the Petitioner and issue a Certificate of vending (hereinafter, 'CoV').

The case of the Petitioner is that the Petitioner has been squatting at the Gujrati Market, Janpath, New Delhi (hereinafter, 'the site') and has been selling readymade garments from the said site. It is the further case of the Petitioner that his father had been squatting from the site, since 1986. 4.

The grievance of the Petitioner in the present petition is that he was not surveyed in the recent Survey conducted by the Town Vending Committee, NDMC.

Mr. Sriharsha Peechara, ld. Counsel for NDMC submits that the Petitioner did not participate in the survey that was conducted by the Town Vending Committee and the survey has already been concluded. 6.

Under these circumstances, the only order that can be passed is that the Petitioner would be permitted to pursue his claims under Section 4(2) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act 2014, if any survey is being conducted by the Town Vending Committee, in the future. The same shall be dealt with in accordance with law. The validity or genuinity of the claims of the Petitioner, have not been verified by the Court.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
