% 27.11.2017 This suit is filed seeking decree of permanent injunction to restrain the defendants, directors, partners etc. from dealing with the domain name www.odomos.com; or the trade mark ODOMOS or any other domain name or trade mark which is identical to or deceptively similar with the plaintiff's registered trade mark ODOMOS. Other connected reliefs also sought. Plaintiff and defendants No.1 and 2 entered into a settlement and the suit was decreed in terms of para 28 b against defendants No.1 and 2. As far as defendants No.3 and 4 are concerned, despite service none has appeared for the said defendants. Accordingly, in terms of Order VIII Rule 10 CPC, a decree is passed in favour of the plaintiff and against defendants No.3 and 4 in terms of para 28 a, b and c. Suit stands disposed of accordingly.
