% 29.01.2019 After some hearing, the learned counsel for the petitioner fairl)' concedes that the impugned order passed by the first appellate court on 19.01.2019 falls within the judicial discretion vested in the said court under Section 389 Cr.P.C., as indeed being in sync with the letter and spirit of Section 148 of Negotiable Instruments Act, 1881, and consequently submitted that he does not press for any relief in the nature of waiver of such deposit as has been directed by the first appellate court. The counsel, at the same time, submitted he may be permitted to withdraw the present petitions and given liberty to approach the first appellate court for enlargement of time for compliance with the directions about deposit.
