O R D E R

% 11.03.2020 Pursuant to order dated 14.02.2020, Dr. D.P.S. Chaudhary was personally present in Court on 18.02.2020, and he submitted that petitioner had compelled him to issue the medical certificate dated 24.07.2019. He further submits that petitioner had threatened him by saying that he is involved in many murder cases and if medical certificate is not issued to him, he would kill him. Therefore, he issued the aforesaid medical certificate.

Vide order dated 18.02.2020, petitioner was directed to appear before IO on 19.02.2020 at 11 a.m. with the mobile phone maintained by him on or before the said date and same was directed to be handed over to IO. IO of the case was directed to file CDR of mobile phone handed over by petitioner, to establish whether petitioner was available at the place of incident.

Learned APP for the State submits that petitioner joined investigation, however, he did not hand over any mobile phone to IO stating that he has not been using any mobile phone for a long time. The stand of petitioner cannot be believed, therefore, I find no merit in the present case. Moreover, petitioner has already been declared a proclaimed offender by Trial Court.
