CRL.M.C. 169/2020 & CRL.M.A. 711/2020 In as much as it is informed on behalf of the State that the investigation in the matter in relation to the FIR No.215/2019, PS Defence Colony is still in progress with the FIR having been registered only on 28.12.2019.

It is apparent that the present petition is pre-mature. Learned counsel for the petitioner thus seeks to withdraw the present petition seeking liberty to file it afresh in accordance with law after completion of investigation, if required.

The petition is dismissed as withdrawn with liberty granted, as prayed.
