This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 by the petitioner for grant of anticipatory bail.

The case of the prosecution is that, on 7.10.2018, Ms. Rachna Yadav (Complainant), president of the RWA, called a meeting at 5:00 pm, which was attended by the petitioner. Meanwhile, it is alleged that the petitioner started making the video of the proceedings. The complainant and other RWAs raised objection to it and asked the petitioner to stop making the video. Instead of stopping, the petitioner started quarrelling with the complainant and used filthy language. It is further alleged that the petitioner manhandled the complainant and caught her by the collar, because of which her suit was torn. Then the petitioner escaped from the spot.

On 8.10.2018, the complainant made another complaint against the petitioner, whereupon an FIR was lodged against the petitioner under Sections 354-A/354-B/506/509 of the Indian Penal Code, 1860.

Learned counsel for the petitioner submitted that investigation has already been completed.

Learned APP submitted that the petitioner is not required for the purpose of investigation.

In view of the aforesaid facts, in case of his arrest, the petitioner be released on bail, on his furnishing a personal bond in the sum of Rs.25,000/-, with one surety of the like amount to the satisfaction of the SHO/IO and further subject to the conditions that the petitioner shall join and co-operate investigation, as and when called by the SHO/IO, in writing; the petitioner shall not act in any manner which may prejudice the investigation or influence the witnesses or tamper with the evidence.
