An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of bail in FIR No. 314/2011, under Sections 399/402 IPC and Section 25 of Arms Act, registered at PS: Crime Branch, Delhi. 2.

Learned counsel for the petitioner submits that petitioner is in custody since 28.09.2023 and the remaining co-accused were acquitted vide judgment dated 30.06.2022 passed by learned ASJ, Tis Hazari Courts, Delhi. 3.

Learned APP for the State opposes the application and submits that the petitioner was untraceable and Section 174A IPC was accordingly invoked for purpose of trial of petitioner, since he was declared as proclaimed offender.

Considering the totality of the facts and circumstances, petitioner is admitted to bail on furnishing personal bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand only) with one surety in the like amount to the satisfaction of the learned trial court and subject to the following conditions:

(i) Petitioner shall provide his present address and mobile number to the Investigating Officer (IO)/SHO concerned at the time of release.

(ii) In case of change of address, petitioner shall intimate/communicate his fresh address to the IO/SHO concerned. Application is accordingly disposed of. Pending applications, if any, also stand disposed of.

A copy of this order be sent to the Superintendent Jail and concerned Trial Court for information and compliance.
