% 11.02.2020 Petitioner is undergoing sentence of life imprisonment in FIR No. 559/2006, under Section 302 IPC, registered at police station Nand Nagri, Delhi. Vide this petition, petitioner is seeing parole for two months on the ground that his wife has to undergo surgery for gall bladder stone and he wishes to maintain family relations and social ties to curb inner stress. Learned Additional Public Prosecutor for State has strongly opposed this petition on the ground that the date of surgery of petitioner's wife has not been fixed. Learned Additional Public Prosecutor for State further submits that after his release on parole from 5th October, 2011 to 3rd November, 2011 [in FIR No. 143/2012, registered at police station W.P.(CRL) 98/2020
Gandhi Nagar], petitioner had jumped parole and could be arrested on 12th May, 2012. Petitioner once again jumped his parole on 24th March, 2016 and could be arrested only on 24th August, 2016. Heard.
I have considered the rival submissions. The conduct of petitioner clearly disentitles him the benefit of parole. This Court does not find merit in this petition and it stands dismissed accordingly. BRIJESH SETHI, J FEBRUARY 11, 2020 r W.P.(CRL) 98/2020
