WP(C) 512/2020 & CM 1386/2020 As the petition involves a limited relief, I do not consider it necessary to issue a formal notice of the same to the respondent. The petitioner is primarily aggrieved of the order dated 08.11.2019 passed by the learned National Consumer Dispute Redressal Commission in EA/83/2017 in Consumer Complaint No. 793/2015 titled Rajesh Kumar Gupta vs. Today Homes and Infrastructure Private Limited, calling upon the petitioner herein to remain personally present before the learned Commission on 20.01.2020.

The learned senior counsel for the petitioner submits that in the Consumer Complaint referred hereinabove, the petitioner was not added as an Opposite Party. The Complaint was only against Today Homes and

Infrastructure Private Limited. He submits and undertakes that pursuant to the notice issued by way of the Impugned Order, the petitioner would be duly represented in the proceedings before the Commission through a counsel.

In view of the above undertaking, the Impugned Order insofar as it directs personal presence of the petitioner before the Commission on 20.01.2020, is set aside.

It is made clear that this Court has not expressed any opinion on the merits of the submissions made by the learned senior counsel for the petitioner on whether the proceedings before the Commission are maintainable against the petitioner.

The petition is disposed of in the above terms. Dasti.
