This is the third call.

Now learned counsel for the accused/applicants has appeared with the request for permission to withdraw these anticipatory bail applications with liberty to file fresh applications before the Trial Court after paying back the dues of all 198 home buyers. It is submitted by learned counsel for the accused/applicants that during pendency of these applications before different predecessor benches, the accused/applicants voluntarily continued to deposit different amounts of money with the Registry of this Court towards settlement of claims of the home buyers in order to establish bona fide of the accused/applicants. Admittedly, the legal position is that the criminal courts, including those dealing with bail matters are not the forum for recovery of money. This Court, therefore, had made it clear that these matters shall be heard on merits.

submits that he shall move a separate application regarding the manner in which the money deposited with the Registry of this Court be dealt with and as regards the remaining claimants, the accused/applicants shall settle separately.

Under the above circumstances, learned counsel for the accused/applicants seeks permission to withdraw these applications with liberty to file afresh before the Court of Sessions in view of change of circumstances in the form of initiation of settlement of claims. 8.
