O R D E R

The present petition is filed by the petitioner seeking issuance of appropriate directions to the Respondents for allotment of an industrial plot under the Relocation Scheme promulgated by the Government of NCT of Delhi.

The case of the petitioner, a proprietorship concern operating under the name 'Sanjay Wire Industries' from Vishwas Nagar, Shahdara, Delhi, is that it had submitted its application vide Form No. 14569 dated 28.12.1996, seeking allotment of an industrial plot under the said Relocation Scheme, intended for industrial units operating in non-conforming/residential areas. It is contended that the Petitioner's name was omitted from the list of successful applicants and thereafter, numerous representations were addressed to the concerned authorities.

closed on account of its residential location. A show cause notice dated 07.08.2018 was issued to the petitioner under the relevant provisions of the Delhi Municipal Corporation Act, 1957 (DMC Act), alleging unauthorized industrial use of the premises.

Admittedly, the Petitioner had earlier approached this Court by way of W.P.(C) No. 1014/2019, wherein similar reliefs were sought. Vide order dated 08.08.2023, this Court disposed of the said petition with a direction to respondent no. 2 to treat the petition as a representation and pass a reasoned and speaking order. The petitioner was granted liberty to take appropriate legal recourse if aggrieved.

In compliance thereof, the petitioner submitted a representation dated 14.08.2023, enclosing documents to substantiate the claim that the industrial unit was operational prior to the date of 19.04.1996 6.

Upon perusal of the record, this Court finds that the petitioner has failed to substantiate the eligibility for relocation by furnishing necessary documents indicating operation of the industrial unit prior to 19.04.1996. In absence of requisite and verifiable documents, this Court finds no merit in the present petition.

This Court is therefore not inclined to exercise its extraordinary writ jurisdiction under Article 226 of the Constitution of India. Accordingly, the petition stands dismissed.
