CM APPL. 31177/2025 By way of the present joint application filed under Order XXIII Rule 3 read with section 151 of the Code of Civil Procedure 1908 ('CPC'), the parties seek leave to close the matter on a compromise, by the appellant withdrawing the appeal.

In view of a substantive application alongwith a copy of the compromise deed having been filed jointly by the parties being, CM APPL. No. 78472/2025, the present application is disposed-of as infructuous. CM APPL. 78472/2025 By way of the present joint application filed under Order XXIII Rule 3 CPC, the parties seek disposal of the appeal in terms of Compromise Deed dated 12.09.2025.

The appellant is present in-person alongwith her counsel. Respondents Nos. 1 and 2 have also joined the proceedings via videoconferencing alongwith their counsel. Learned counsel for the parties submit, that as per the terms of their settlement, the appellant is entitled to withdraw the sum of Rs. 5.25 lacs that was deposited in this court in compliance of order dated 07.03.2022, being 75% of the decretal amount, alongwith the interest earned on that sum uptodate. Furthermore, in consideration of the settlement, it is agreed that the appellant would also withdraw the appeal; and the parties would not press any other claim against each other arising from the transaction that was subject of the present proceedings.

The application is supported by affidavit of the appellant and the respondents. The parties undertake to be bound by the terms of the settlement.

In view of the above, the present application is allowed. RFA 68/2022 In view of the above, the present appeal is disposed-of as withdrawn. Pending applications, if any, stand disposed-of. The Registry is directed to release in favour of the appellant the amount lying deposited in the present proceedings, alongwith upto-date interest, within 02 weeks of the appellant approaching for the purpose, after verifying her credentials.
