This contempt petition was filed on the basis of submissions recorded in paragraph 36 of the Original Reference order dated 27th August 2010 rendered by a Three Judge Bench of this Court which is extracted as under: 2.

Counsel for respondent states that they are in the process of formulating the rules. However, they object to the Contempt Petition subsisting, as no particular direction was passed in the above order, which is not being complied.

subsist. A submission had been recorded in the order dated 27th August 2010 stating that the State Government was "contemplating" to frame a set of rules. This cannot amount to a Court mandate regards which contempt petition can subsist.

In any event, counsel for respondent has stated that steps are being taken in this regard. He also states that a new Education Act is in process and, therefore, a committee has been formed.

Notwithstanding, petitioner is entitled to address representations to respondent in this regard, which shall be taken into account to support the next steps being taken by the respondent.

Accordingly, petition stands disposed of.

Basis petitioner's counsel's submissions, petitioner will always be at liberty to take steps in accordance with law before the appropriate Court in order to seek a writ of mandamus, for this purpose. 8.
