% 25.07.2024 Learned counsel for the respondent submits that the respondent/complainant does not want to proceed against the petitioner. Learned counsel submits that in fact, the complaint was filed against four persons including petitioner as respondent no.4. However, learned counsel submits that in the entire complaint, they have not made any averment against the present petitioner. Learned counsel also submits that on instructions, the respondent/complainant shall delete the petitioner from the array of the parties.
In view of the submissions made, the present petition is allowed. The summoning order dated 29.03.2022 qua the petitioner is set aside. The petition along with pending application stands disposed of.
