By way of the present application, the applicant seeks interim bail in connection with FIR No. 668/2022 dated 17.09.2022, registered at Police Station Jafrabad, District North-East, New Delhi, under Section 302 of the Indian Penal Code, 1860 ["IPC"], in order to attend the wedding of his brother.

I have heard Mr. Anand Prakash Sharma, learned counsel for the applicant, and Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor for the State.

Mr. Chauhan has handed up a status report in Court, which is taken on record.

According to the applicant, the marriage of his brother is scheduled to be held on 29.03.2026, and the reception on 30.03.2026. These facts have been verified by the Investigating Officer, who has recorded the statements of the brother of the applicant, who is getting married, as well as the applicant's father. Mr. Sharma also points out that co-accused Shahdeen @ Shaan was granted interim bail by the Sessions Court on three occasions for various purposes, including the wedding of his sibling. 6.
Although the charges against the applicant, which are under Section 302 of the IPC, are serious, I am informed that all material witnesses have already been examined. The applicant has been in custody for over three and a half years.

Considering the aforesaid circumstances, I am inclined to release the applicant on interim bail, which would assist in maintenance of familial and social ties.

Accordingly, it is directed that the applicant be released on interim bail in connection with FIR No. 668/2022 dated 17.09.2022, registered at Police Station Jafrabad, District North-East, New Delhi, under Section 302 of the IPC, for a period of one week from 27.03.2026, subject to his furnishing a bail bond in the sum of Rs. 20,000/-, with one surety in the like amount, to the satisfaction of the concerned Jail Superintendent, and subject to the following further conditions:
a. The applicant shall furnish his permanent address to the concerned Investigating Officer ["IO"]/Station House Officer ["SHO"], as also the address where he is residing during the period of his release.
b. The applicant shall furnish his mobile number to the concerned IO/SHO, and shall ensure that the said mobile number remains operational and switched on at all times. c. The applicant shall not leave the National Capital Territory of Delhi during the period of interim bail.
d. The applicant shall not, directly or indirectly, contact, nor visit, nor offer any inducement, threat, or promise to the family of the deceased, or any of the prosecution witnesses or other persons acquainted with the facts of the case.
e. The applicant shall not, directly or indirectly, tamper with evidence nor otherwise indulge in any act or omission that would prejudice the proceedings in the pending trial.
f. The applicant shall not commit any offence during the period of his release.
g. The applicant shall surrender before the concerned Jail Superintendent at or before 5:00 PM on 04.04.2026. 9.
The bail application, alongwith pending applications, stands disposed of in the above terms.

It is clarified that any observations made in the present order are solely for the purpose of deciding the present bail application, and shall neither influence the trial proceedings, nor be construed as an expression of opinion on the merits of the case.
