O R D E R

% 10.05.2019 Petitioner seeks regular bail in FIR No. 1191/2018, under Sections 304/34 of IPC, registered at Police Station Aman Vihar, Delhi while claiming to be innocent.

Learned Additional Public Prosecutor has handed over a copy of the status report and submits that deceased had died due to beatings given by the petitioner and his co-accused and other public persons, as the deceased was apprehended on the suspicion of a thief. Learned counsel for petitioner submits that due to fear of apprehension, the deceased had jumped from the building and fell on an autorickshaw and then on the ground and he fainted and that the deceased was a habitual drunkard and was involved in many criminal cases. It is submitted that petitioner is in custody since 1st December, 2018 and he deserves concession of bail, as the trial of this case is likely to take time.

Upon hearing and on perusal of FIR of this case and status report filed, it is directed that petitioner be admitted to bail upon his furnishing bail bond in the sum of ₹20,000/- with one local surety in the like amount to the satisfaction of trial court.

The bail application is accordingly disposed of, while not commenting upon the merits of this case.
