CORAM:

% 16.01.2020 CRL.M.A. 800/2020 1.

Allowed, subject to all just exceptions.

W.P.(CRL) 122/2020 2.

The petitioners have filed the present petition, inter alia, praying that directions be issued to respondent nos.1 to 3 to provide adequate security to the petitioners.

3.

The petitioners claim that they have married to each other and are apprehensive about their safety, as the family members of petitioner no.1 have opposed their marriage.

Respondent no.4 is the father of petitioner no.1 and it is stated that he has also issued threats against the petitioners.

4.

It is pointed out that the petitioners had, earlier, filed a petition (W.P.(Crl.) 1730/2018) claiming that they are majors and had married each other out of their free consent. Investigations have revealed that petitioner no.1 was not an adult at the material time and consequently, she was handed back to her parents.

5.

An FIR in that regard has also been filed against petitioner no.2 (FIR No.44/2018, registered with PS Sangam Vihar). Investigating Officer, SI Jeetender, PS Sangam Vihar in the said FIR is present in Court and he states that it has since been verified that petitioner no.1 has now turned major. 6.

In view of the above, the present petition is allowed. SHO, PS Tigri and SHO, PS Sangam Vihar are directed to evaluate the threat perception and provide the petitioners such protection, as they consider necessary. They shall also provide mobile numbers of the beat staff in order to enable the petitioners to contact the said staff in case of any eventuality. 7.
