% 14.12.2024 Appellant claimant has filed an appeal for enhancement of the award.
We have interacted with the learned counsels for the parties present. Whereas learned counsel for the Insurance Company has offered to pay the amount of compensation enhanced to Rs. 1,75,000/, learned counsel for the claimant on instructions submits that he has instructions to get the matter settled for enhanced compensation of Rs. 1,90,000/-.
Having regard to the nature of injuries which were suffered by the claimant, enhancement of compensation is warranted and it would be fair to award compensation of Rs. 1,90,000/- in a lump sum over and above the amount as full and final settlement by the learned The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Tribunal. Learned counsel for the appellant/Insurance Company concedes to the suggestion by this Bench.
The Insurance Company is accordingly directed to deposit the enhanced amount of Rs. 1,90,000/- before the concerned Tribunal within a period of five weeks from today, failing which the respondent shall be liable to pay interest @ 9% p.a. for the delayed period. The concerned learned Tribunal shall release the aforesaid amount alongwith interest, if any, to the appellant, subject to verification and completion of requisite formalities.
The present appeal alongwith the pending application(s), if any, is disposed of in terms of the foregoing settlement A copy of this order be sent to concerned learned Tribunal with LCR, if requisitioned and received.
