This is a petition filed by the Petitioner-M/s. Yos Sports and Entertainment Private Ltd. under Section 29A(5) of the Arbitration and Conciliation Act, 1996 (hereinafter, 'the Act') seeking extension of the mandate of the Arbitrator.

As per the Petition, the Petitioner filed OMP (I) COMM No. 77 of 2019 before this Court, aggrieved by the Respondent acting contrary to the agreement dated 21st December, 2015. Vide order dated 14th April, 2019, a sole Arbitrator was appointed. Consequently, the Arbitration Proceedings commenced on 16th May, 2019.

It is observed that, since the commencement of the proceedings, two extensions have been granted i.e. an extension of 6 months in OMP MISC COMM NO.56/2023 vide order dated 13th April, 2023 and in OMP MISC COMM NO.507 /2023 vide order dated 12th October, 2023. Ld. Counsel for the Petitioner submits that he was having some medical issues, due to which he could not take care of the matter. He submits that the last extension may be granted for concluding the proceedings.

Ld. Counsel for the Respondent has appeared and submits that the Court may pass appropriate orders keeping in mind the background. 7.

It is observed that various extensions have already been granted and on this occasion, ld. Counsel for the Petitioner has prayed that extension may be granted as delay was solely due to his medical issues. 8.

In view of this matter, the mandate of the Arbitrator is extended till 31st December, 2024.

Proceedings shall take place on a regular basis and award shall be pronounced by the said date i.e., by 31st December, 2024. If any unnecessary adjournment is sought by either of the parties, ld. Arbitrator is free to impose costs on the parties.

Petition is disposed of. Pending applications, if any, are accordingly disposed of.
