CRL.M.C. 233/2018 1.

The petitioner seeks quashing of FIR No.378/2016, under Section 135 of the Indian Electricity Act, Police Station Malviya Nagar, Delhi.

The subject FIR has been registered on account of an alleged theft of electricity. The electricity bill of Rs.425,288.84 was raised on account of the alleged offence. The parties have settled the disputes Crl.M.C.233/2018

and settled the amount at Rs.2,98,000/-.

Learned counsel for the petitioner submits that the petitioner has paid the amount of Rs.2,98,000/- and accordingly, prays for quashing of the subject FIR.

Learned counsel appearing for respondent no.2 submits that the settlement amount has been paid and she has no objection to the subject FIR being quashed.

In view of the fact that the dispute emanates under Section 135 of the Indian Electricity Act and the parties have settled their dispute, the petitioner has paid the amount of Rs.2,98,000/- and the respondent No.2 has no objection to the quashing of the FIR, there would be no fruitful purpose in continuing with the prosecution. It would further be expedient and in the interest of justice to quash the FIR and the consequent proceedings.

In view of the above, FIR No.378/2016, under Section 135 of the Indian Electricity Act, Police Station Malviya Nagar and the consequent proceedings emanating therefrom are hereby quashed. 7.
