The present writ petition has been filed alleging that the respondent no.2 is installing a telecom tower at its premises without any valid permission from the respondent/MCD.

It appears that the present writ petition has been filed without examining the relevant regulation, i.e., Telecommunication Right of Way Rules, 2024.

A copy of the relevant regulations has been handed over by Ms. Meherunnisa Anand Jaitley, counsel appearing on behalf of the MCD, to the counsel for the petitioners.

Counsel for the petitioners seeks to withdraw the present writ petition with liberty to file a fresh writ petition after examining the relevant regulations.
