% 18.01.2016 CM. APPL. No.738/2016 (u/S 151 CPC for Stay) in W.P.(C) 172/2016 By this application, it is prayed that respondent no.1 be directed to stop the illegal construction at B-10/7550, Vasant Kunj, New Delhi carried out by the respondent no.2.

Learned counsel for the respondent no.1 submits that subject premises has already been inspected and booked on 8th January, 2016 inasmuch as demolition notice has also been issued. It is submitted that further action, in accordance with law, will be taken in due course. Respondent no.2 submits that no construction is being carried out at the subject property. In view of this statement, petition is not pressed at this stage and disposed of accordingly.

Respondent no.1 shall keep watch and

ensure that no further construction is being carried out and action, in accordance with law, be taken against the unauthorized construction. A.K. PATHAK, J.
