% 06.07.2017 The petitioner is aggrieved by the order dated 10.08.2016 passed by the Tehsildar, Defence Colony which order was passed pursuant to a direction contained in the order dated 03.06.2016. He is also aggrieved by an order passed by the District Magistrate dated 16.06.2016. Contention of the petitioner is that he is in cultivatory possession of his land in village Okhla, Jogabai and Kilokari; details are not relevant to be reproduced as this Court is not dealing with the merits of the case.

At this stage, learned counsel for the respondents submits that these orders are subject to challenge before the Revenue Authorities and the petitioner having alternate remedy of filing an appeal before the concerned Competent Authority, this petition would not be maintainable.

Learned counsel for the petitioner seeks permission of this

Court to withdraw this petition with liberty granted to the petitioner to pursue his remedy before the Competent Authority i.e. Revenue Authorities.

Petition disposed of in the above terms.
