The present petition under Section 9 of the Arbitration and Conciliation Act, 1996 has been filed by the Petitioner with the following prayers:

"A. Pass an order staying the operation, implementation and effect of the Termination Order No.

HPMC/DMRC/2022/V-1-3911-13 dated 10.02.2026 issued by Respondent, during the pendency of the arbitral proceedings;

B. Pass an order restraining the Respondent, its agents, officers, employees, or anyone acting on its behalf, from dispossessing the Petitioner from the 59 kiosks situated at various metro stations of the DMRC network and from interfering in any manner with the peaceful possession, operation and management thereof, pending adjudication of disputes through arbitration;

C. Pass an order restraining Respondent from creating any third-party rights, interests, license or operational arrangements in respect of the said 59 Kiosks or from handing over, allotting or re-licensing the same to any third party, during the pendency of the arbitral proceedings;

D. Pass an order directing maintenance of status quo ante as on 10.02.2026 with respect to the Agreement dated 22.06.2023 and the Petitioner's right to operate the said 59 Kiosks, pending constitution of the Arbitral Tribunal and conclusion of arbitral proceedings; E. Pass an ad-interim ex-parte order in terms of prayers (A) to (D) above;

F. Award cost of the present proceedings against the Respondent and in favour of the Petitioner; and G. Pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice." 2.

Learned Counsel appearing for the Respondent, on instructions, very fairly submits that communications have already been issued to the Petitioner for negotiations. The statement is taken on record. 3.

It is made clear that the Respondent shall not take any steps which can have the effect of overreaching the negotiations or the issue which has been raised in this Court during the pendency of negotiations. 4.

In view of the above, the petition is disposed of, along with pending application(s), if any. This Court has not made any observations on the merits of the case.
