% 29.01.2019 After some hearing and upon his attention being drawn ruling of the Supreme Court reported as Parbatbhai Aahir alias Parbatbhai Bhimsinhbhai Karmur and Others v. State of Gujarat and Another, (2017) 9 SCC 641, the learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition, the second petitioner Anita, however, reserving her right to approach the court of Magistrate under Section 320 Cr.P.C. for compounding of the offence under Section 323 IPC.

The petition and the application filed therewith are dismissed as withdrawn.
