% 24.02.2025 CRL.M.A. 5866/2025 (exemption) Exemption granted, subject to just exceptions. The application stand disposed of.

W.P.(CRL) 628/2025 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners, who are newly-wed and have got married on 16.01.2025 against the wishes of petitioner No.1's family, seek protection against alleged unlawful threats at the hands of respondent No.2, who is the father of petitioner No.1. 2.

The marriage has been performed in Vijay Nagar, Ghaziabad, Uttar Pradesh ('U.P.'). A copy of the Certificate of Registration of Marriage dated 17.01.2025 issued by the Marriage Registration Officer, Ghaziabad, U.P. has also been appended to the petition. The petitioners are presently residing away from their native place in Bulandshahar, U.P., under the jurisdiction of P.S.: Saroop Nagar, Delhi.

Issue notice.

Mr. Sanjay Lao, learned standing counsel appears on behalf of the State on advance copy; accepts notice; and submits that though the Delhi Police is willing to provide to the petitioners protection as prayed-for, all further proceedings would have to be conducted before the jurisdictional court in Ghaziabad, Uttar Pradesh. 6.

Mr. Lao informs the court, that as per the Investigating Officer, respondent No.2 has also got an FIR registered against petitioner No.2 under section 87 of the Bharatiya Nyaya Sanhita 2023, namely for kidnapping, abducting or inducing a woman to compel her marriage. 7.

In view of the order that this court proposes to pass, it is not considered necessary to issue notice to respondent No.2. 8.

The petition is disposed-of with a direction to the S.H.O., P.S.: Saroop Nagar, Delhi to furnish to the petitioners his cellphone number, as well as the cellphone number of the concerned Beat constable, who the petitioners may call in any eventuality.
