Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners for quashing of Complaint Case No. 6901/2019 dated 09.08.2007 under Section 296/297/34 of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at P.S. Uttam Nagar and all other proceedings emanating therefrom, in terms of the Settlement Deed dated 28.08.2024.

It is submitted that the matter stands duly compromised in terms of Mediation Settlement dated 28.08.2024.

The learned MM vide order dated 05.10.2024 has compounded the offence punishable under Sections 298/506 IPC, as they are compoundable in terms of the Mediation Settlement.

compoundable offences under Sections 296/297/34 IPC in terms of the Settlement.

The Petitioner No. 1 is PO and the Petitioner No. 3 has already been abated since deceased. All the other parties are present in the Court and are identified by their respective Counsel. The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement. 6.
The parties have submitted that all the disputes have been amicably settled vide Settlement dated 28.04.2024 and thus, the present Complaint Case be quashed, as no fruitful purpose will be served in continuing with the proceedings.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to neighbours, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned Complaint Case and the proceedings pursuant thereto.

Accordingly, the Complaint Case No. 6901/2019 dated 09.08.2007 under Sections 296/297/34 IPC registered at P.S. Uttam Nagar and all other proceedings emanating therefrom are quashed.

The Petition stands disposed of.
