% 02.03.2016 CM No.5589/2016 This is a joint application under Order 23 Rule 3 CPC seeking permission to withdraw the present petition.

For the reasons given in the application, the same is allowed. Accordingly, the application stands disposed of. W.P.(C) 187/2016 & C.M.No.758/2016 By way of present petition under Articles 226 and 227 of the Constitution of India the petitioner seeks setting aside of order dated 19.11.2015 passed by learned Delhi School Tribunal in Appeal No.68/2014.

Ms. Prarthna Sampath, learned counsel for the petitioner submits that the parties have amicably settled the matter and compromised deed has been executed on 12.02.2016. She also

submits that the petitioner has paid the entire amount and has issued experience certificate to respondent No.1 in terms of settlement. Learned counsel for the parties also submits that a joint application bearing CM.No.5589/2015 has been filed seeking permission to withdraw the present petition.

In view of the aforesaid application, the petition as well as application stand dismissed as withdrawn.
