The present application is filed under Section 439 Cr.P.C. on behalf of the petitioner seeking bail in FIR No.243/2019, registered under Sections 420/34 IPC at Police Station Najafgarh, Delhi. 2.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He further submits that the petitioner has not received any amount in the present case and whatever amount was received by him, the same has been handed over to the co-accused. 3.

Learned APP for the State, on the other hand, opposes the bail application and submits that an amount of Rs.4 lacs was received by the present petitioner by way of cheque and the said amount has been credited in

his account. He has referred to the status report wherein it has been stated that the petitioner is also involved in a similar case of cheating, bearing FIR No.297/2019, registered under Section 420/34 IPC at Police Station Najafgarh.

In view of the aforesaid facts and circumstances of the case, I do not deem it fit to grant bail to the petitioner. The bail application is accordingly dismissed.
