This petition lays a challenge to the order passed by the Armed Forces Tribunal (AFT) dated 23.02.2026 whereby, the Tribunal while deciding the prayer of the petitioner for suspension of sentence has in paragraph 7 stated as under:
"7. Taking note of the totality of the circumstances and considering the fact that the pre-confirmation petition filed by the applicant on 21.01.2026 is yet to be decided by the competent authority, it is directed that the matter be listed for The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. consideration of the application for suspension of sentence after six weeks. In the meanwhile, the competent authority before whom the confirmation petition under Section 164 (1) of the Army Act is pending shall take up the petition and decide the same before the next date of hearing and submit a report to this Tribunal. However, upon confirmation, the matter shall be reported to this Tribunal and the applicant shall be sent to the Civil Jail only after obtaining leave of this Tribunal" 4.
We have been informed by the learned counsel for the respondents that the respondents have decided the Pre-Confirmation Petition. 5.
Mr. S S Pandey, learned Counsel for petitioner has stated that the order has not been conveyed to the petitioner. Let the order be conveyed to the petitioner or to his counsel within two days. 6.
The learned counsel for the respondents state that the order thereof shall also be placed before the AFT. As the Tribunal has deferred the matter to await a decision on the Pre-Confirmation Petition, which has since been decided, we direct the listing of the matter on 02.04.2026, before the Tribunal with a request to the Tribunal to consider the application of the petitioner for suspension of sentence on 02.04.2026. 7.
The petition is disposed of.

The pending application is also disposed of as having become infructuous.
