W.P.(C) 662/2020 & CM APPL. No. 1867/2020 This is a petition under Article 226 of the Constitution of India, arising from a tender issued by the respondent. 2.

In this case, a tender was invited on 13.12.2019. The grievance of the petitioner is that the result of the pre-bid meeting is not known to the petitioner, and respondent No. 2 is now inviting bids, with the last date of submission of bids being 16.01.2020. Thus, according to the petitioner it is unclear as to what the outcome of the pre-bid meeting was; and as to whether respondent No. 2 considered the matters raised by them in the prebid meeting. Mr. Satyakam, learned Additional Standing Counsel appearing for the respondent, who enters appearance on an advance copy, submits that this petition is premature. He submits that no final decision has been taken in the matter and the decision on the issues discussed at the pre-bid meeting would be duly considered by respondent No. 2. Moreover, the last date is being extended from 16.01.2020 to 27.01.2020.

Mr. Navlendu Kumar, learned counsel appearing for the petitioner, states that in view of what is stated by the respondent, he does not wish to press the petition at this stage but would seek liberty to approach this court again, in case the petitioner has any grievance. 5.

Mr. Kumar however, submits that in case a corrigendum is issued one or two days before 27.01.2020 (the extended date) the petitioner may not get any time to challenge the same. In response, learned counsel for respondent No. 2 submits that the respondent will ensure a minimum gap of 10 days between the date of issuing any corrigendum and the last date of submission of bids.

Taking on record the foregoing statement made on behalf of the respondent, the writ petition and CM APPL. 1867/2020 are accordingly dismissed as not pressed. Liberty, as prayed for, is granted to the petitioner. G.S.SISTANI, J.
