O R D E R

% 19.01.2017 The petitioner has filed the present bail application under Section 439 to seek regular bail in case FIR No.608/2016 registered on 30.11.2016 under Section 308/ 341/ 34 IPC.

At this stage, I may observe that the case has been converted to one under Section 304/ 34 IPC since the victim has passed away allegedly on account of the injuries suffered by him. The petitioner is in judicial custody since 03.12.2016. The case involves a serious offence, which has led to the demise of the victim. The case is still at the investigation stage. The submission of learned counsel for the petitioner is that one of the co-accused has been released on bail. However, that is on account of the

fact that the said co-accused Khushi is a juvenile. In these circumstances, I am not inclined to grant any relief to the petitioner at this stage.

Dismissed.
