The petitioner has filed a complaint dated 22.10.2024 under Notaries Act, 1952 against a notary alleging grave misconduct. 2.

It is submitted that the competent authority i.e. respondent no.2, obtained a reply from the concerned notary and initiated an inquiry. The petitioner is aggrieved by the fact that on 15.02.2025, it received a notice dated 11.02.2025 from the respondent authority for a hearing scheduled on 27.02.2025 pertaining to the complaint filed by the petitioner. It is stated that therein the respondent authority has erroneously recorded the complaint date to be 20.10.2024 instead of 22.10.2024. Further, the reply furnished by the concerned notary has not been supplied to the petitioner. 3.

Learned counsel for the respondents fairly submits that during the course of inquiry, the respondent no.2 shall scrupulously adhere to the principles of natural justice. He further accedes that the copy of the reply furnished by the concerned notary shall be supplied to the petitioner. further submits that the record shall necessarily reflect the accurate date on which the complaint was preferred by the petitioner. The aforesaid statement is taken on record.

Considering the aforesaid, no further orders are required to be passed in the present petition. The same is accordingly, disposed of. 5.

Learned counsel for the petitioner submits that the hearing scheduled on 27.02.2025 before the respondent no.2 be rescheduled. The petitioner is at liberty to make this request before the respondent no.2.
