This suit is instituted on behalf of the Plaintiff seeking a decree of permanent injunction restraining the Defendants and all others acting on their behalf from manufacturing, exporting, selling, offering for sale any goods or services wherein Defendants' LINOCIN mark and any other mark which is identical or deceptively similar to the Plaintiff's LANOXIN mark amongst other reliefs.

Mr. Rahul Vidhani, learned counsel enters appearance on behalf of the Defendants on advance copy of the plaint and on instructions, states that the Defendants shall not be using the impugned mark LINOCIN and/or any CS(COMM) 241/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. other mark identical or deceptively similar to the Plaintiff's mark LANOXIN and are willing to suffer a decree of injunction. 5.
Learned counsel for the Defendants, however, submits that Defendants be permitted to exhaust the existing stock on or before 30.06.2026, details of which will be furnished on an affidavit before the Court with copy to learned counsel for the Plaintiff, within one week from today.

Learned counsel for the Plaintiff, on instructions, submits that Plaintiff has no objection to the Defendants' exhausting the existing stock, details of which will be disclosed in the affidavit and will immediately stop the manufacture of any fresh products under the impugned mark. Learned counsel for the Plaintiff, on instructions, gives up all other reliefs. 7.
In light of the statement made by learned counsel for the Defendants which shall bind them, the suit is decreed in terms of paragraph 55(a) to (d). Defendants shall withdraw the application being Application No. 7192488 for registration of trade mark LINOCIN within three weeks from today. 8.
Registry is directed to draw up the decree sheet. 9.
Suit is disposed of along with pending applications. 10.
Plaintiff is held entitled to refund of entire court fees in accordance with Court Fees Act, 1870. Certificate of court fee shall be prepared in the name of Plaintiff's counsel i.e. 'Sujata Chaudhri IP Attorneys'.
