% 06.02.2017 Present contempt petition has been filed alleging wilful disobedience of the status quo order passed by this Court on 21st October, 2013 in W.P.(C) No.3941/2013.

In reply-affidavit filed by the DDA, it is stated that there has been no violation of the status quo order by DDA. It is further stated that the action, with regard to the unauthorised weekly market, shown in the photographs annexed with the petition, has to be taken by SDMC.

In pursuance to the notice issued by this Court, Mr.Ajit Kumar, Licensing Inspector, SDMC is personally present in Court. He admits

that an unauthorised weekly market is being held in the area in question. He, however, states that SDMC has granted no permission for the same and action against the encroachers/shopkeepers needs to be taken by DDA.

Learned counsel for the DDA states that DDA along with the officials of SDMC is willing to remove the unauthorised weekly market.

To obviate any challenge on account of jurisdiction, both SDMC as well as DDA are directed to ensure that no unauthorised weekly market is held in the area in question, in accordance with law. In the event, the SDMC and the DDA require any police assistance, the same shall be provided by the Delhi Police. Since the W.P.(C) No.3941/2013 has already been disposed of, this Court is of the view that no further orders are called for in the present contempt petition.
