% 09.03.2016 Present writ petition has been filed challenging the order dated 16th November, 2015 passed by respondent No.2. Petitioner also seeks reopening of his case. Petitioner, who appears in person, states that he and his family members belong to caste JATAV (Scheduled Caste). He states that he reported to the National Green Tribunal about the illegal mining activities of the sand mafia at Faridabad and in retaliation he was attacked and severely beaten. Petitioner also states that on 23rd November, 2014, he and his family members due to the aforesaid incident were compelled to leave their house and since then they have been homeless.

Petitioner states that he had approached the National Commission for Scheduled Caste with his grievances.

He states that on 08th December, 2015 he was forwarded a copy of the report received from the Deputy Commissioner and was asked by the National Commission to file his rejoinder within thirty days. He, however, points out that the impugned order closing his case was passed on 08th December, 2015 itself without waiting for his rejoinder. Learned counsel for respondents, who appears on advance notice, states that the National Commission is willing to give a fresh hearing to the petitioner.

Keeping in view the aforesaid statement, the order dated 16th November, 2015 is set aside and the petitioner is permitted to file a rejoinder affidavit within a period of one week.

Petitioner is directed to appear before the National Commissioner on 28th March, 2016.
