Learned counsel for the respondent submitted that, in the interest of justice and just to cut short the delay, one more opportunity may be given to the petitioner to cross-examine, CW-1.

Learned counsel for the petitioner submitted that the petitioner may be granted only one opportunity for the purpose of cross-examination, on which date the petitioner shall conclude the cross-examination and shall not seek any adjournment whatsoever on any ground.

In view of the aforesaid submissions of the learned counsel for the parties, the impugned order dated 19.12.2018 is set aside. The petitioner is granted one more opportunity to cross-examine CW-1, subject to cost of Rs.25,000/-, as agreed between the parties.

It is submitted by the learned counsel for the parties that the matter is now fixed for 1.6.2019 before the Trial Court. On 1.6.2019, the Trial Court shall fix a date for cross-examination of CW-1. It is directed that the petitioner shall not seek any adjournment whatsoever and conclude the cross-examination on the date so fixed by the Trial Court on 1.6.2019. Learned counsel for the petitioner submitted that the petitioner shall pay the cost of Rs.25,000/- on 1.6.2019 before the Trial Court. 5.
The petition is disposed of in above terms. Pending application is also disposed of.
