Accordingly, the present application is disposed of. CM APPL. 15469/2026 (seeking stay of the Order dated 16.02.2026) 3.

Learned Counsel for the appellant submits that the impugned order was passed ex parte, without granting any opportunity of hearing to the appellant. 4.

Learned Counsel for the respondent does not dispute the said fact. 5.

In view thereof, without going into the merits of the case, the impugned order is set aside.

The matter is remanded back to the learned Family Court. 7.

The learned Family Court shall hear the application afresh and pass an appropriate order expeditiously after hearing both the parties, in accordance with the law.
